  1. Protecting Scouts Canada: Some observers and abuse survivors claim the NDAs functioned mainly to protect the reputation of Scouts Canada and minimize media attention on the organization.
  1. Hiding systemic issues: By keeping the details of settlements confidential, the NDAs in effect obscured the full extent of the Scouts Canada sexual abuse problem and delayed needed systemic reforms.

Has Scouts Canada Changed?

Scouts Canada has established a dedicated, centralized system to manage sexual abuse allegations. This system requires:

  1. Immediate reporting: An adult volunteer with Scouts Canada who suspects or is informed about abuse must immediately report it to the provincial child protection services or the police, as well as the Scouts Canada Safe Scouting Department.
  1. Immediate action: It is the policy of Scouts Canada to suspend immediately anyone who is the subject of a sexual abuse allegation while an investigation is pending and to terminate any volunteer who faces a child abuse charge.
  1. Support for victims: If a youth discloses abuse to an adult volunteer, the adult is to listen, believe, and reassure but make no promise to keep the disclosure confidential. The adult must report the claim and explain the Scouts Canada reporting requirement to the youth.

These policies indicate Scouts Canada has made a shift toward transparency and accountability, emphasizing that the welfare of young people, and not the organization’s reputation, must be Scouts Canada’s foremost priority.

The police and the Crown Prosecutor’s office handle criminal charges for sexual abuse. If many years have passed since the abuse, it may be impossible to win a criminal conviction, especially if the Scout Leader is deceased. A civil claim requires a lower standard of proof and may provide an abuse survivor with compensation for medical and counseling costs and psychological damages. Civil claims against Scouts Canada can be filed even if the Scout Leader is deceased.
